1. Use of Website
All rights reserved. The public areas of this website are provided to inform the users of the world wide web about the products and services provided by StatPlan Energy Limited. Individuals may print or save portions for their own personal use. Permission must be obtained from StatPlan Energy in order to make any other use of the material that appears on this site. Requests to reprint StatPlan Energy material should be in written form and should specifically state the item(s) to be reprinted, the purpose, and distribution of the reprints. Requests for permission to reprint from StatPlan Energy materials should be referred to e.blauvelt@statplanenergy.com.
2. Use of Reports
Our reports contain information about global energy markets. The information is not advice, and should not be treated as such. StatPlan makes every reasonable effort to ensure that data we present is an accurate representation of our many data sources, but cannot vouch for the accuracy of the source material. Where different sources conflict, we take a view on the most accurate position.
We do not represent, warrant, undertake or guarantee that the information in the report is correct, accurate, complete or non-misleading, or that the use of guidance in the report will lead to any particular outcome or result.
3. Limitations and exclusions of liability
The limitations and exclusions of liability set out in this section are subject to section 5 below; and govern all liabilities arising under the disclaimer or in relation to the reports, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.
We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control. We will not be liable to you in respect of any business losses, including without limitation loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill. We will not be liable to you in respect of any loss or corruption of any data, database or software. We will not be liable to you in respect of any special, indirect or consequential loss or damage.
4. Law and jurisdiction
This disclaimer will be governed by and construed in accordance with English law, and any disputes relating to this disclaimer will be subject to the exclusive jurisdiction of the courts of England and Wales.
5. Terms and Conditions of Sale
Sales of publications are final. Prices quoted on the website are final unless the customer has written confirmation from StatPlan of any agreed arrangement (for example, in the case of multiple purchases or long term arrangements to purchase).
For on-line sales, customers will receive their purchases once payment has been confirmed. No liability is accepted for any failure to meet this service standard.
Where StatPlan Energy is required to provide an invoice for payment by means other than through the website, StatPlan will require (a) written confirmation of the order, and (b) a purchase order number, or written confirmation that it is not required.
Where payment is by invoice, our terms are strictly 30 days from date of invoice. We reserve the right to discontinue supply against ongoing arrangements if these terms are not met.
The cost of providing hard copies of reports will be agreed in advance and in writing.
In the circumstance where customers can order in advance of publication, we indicate but do not guarantee a delivery date. However, should we fail to deliver within 30 days of the stated date, we will offer customers the option of their money back.
We reserve the right not to fulfil orders if we judge it is not in our interest to do so. In this circumstance and monies received will be returned. In purchasing any StatPlan Energy report or database, the buyer undertakes:
- Not to reproduce the information for anything other than his own use
- Not to distribute the information in any way beyond the bounds of his organisation, and
- Not to distribute the information beyond the agreed licence (The three licence levels are: single use, multi-use and Intranet publication).
Failure to adhere to these standards will be considered a breach of StatPlan Energy’s Intellectual Property rights.
6. Intellectual Property
All intellectual property rights relating to the content of paid for StatPlan Energy reports, databases or freely available materials shall at all times remain vested in StatPlan Energy. Sale of reports and databases does not mean that it becomes the intellectual property of the buyer.
